As a client, you have the right to dismiss your attorney at any time during your family law case. Not all attorneys are the same. They have varying experience and expertise in managing different types of situations. Finding the right attorneys is a cumbersome task.
There can be many reasons why you’d want to fire your attorney. Whether they cannot meet your goals, don’t communicate, or lack ethics – you can fire your attorney whenever you want. However, there may be repercussions. So when is it too late to fire your attorney?
Reasons to Fire Your Attorney
· Poor communication
· Lacking experience
· Unethical behavior
· Unreasonable billing practices
· Unprofessional
· Disagreements
Firing your Attorney Late can Cost you
If your attorney has made substantial progress in your case like reaching a negotiated agreement with your ex-spouse – firing them at this stage could be detrimental to your interests. It may also reverse all the progress gained during the settlement. In addition, your previous attorney may have a valid claim to their full legal fee if stipulated in the client-attorney agreement. In special cases, you may also have to notify the court and obtain permission before changing attorneys.
Lastly, your new attorney may require additional time to prepare for your case, thus prolonging your dispute.
